Frequently Asked Questions

How long do I have to make a building dispute claim in NSW?

Under the Home Building Act, the primary defect period is 6 years from the completion of the work for major defects, and 2 years for all other defects. For structural defects specifically, there is a 10-year long-stop limitation period that applies regardless of when the defect was discovered. How much does a building dispute cost to resolve?

Cost depends on the forum and whether the matter is contested. NCAT matters are generally more cost-effective than court proceedings, with simple, undisputed claims sometimes resolving for a few thousand dollars in legal fees. Do I need to go to NCAT, or can I go straight to court?

For most residential building disputes up to $500,000, NCAT is the required first forum, you generally cannot commence court proceedings without first attempting resolution through NCAT or, for smaller claims, the Building Commission. Commercial construction disputes, or matters exceeding NCAT’s monetary jurisdiction, may need to proceed directly to court. What should I do if I think my builder has done defective work?

Can I withhold payment if I'm not happy with the work?
